1. Acceptance of Terms

By accessing or using Mollyra AI's platform, APIs, documentation, or related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and representing that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, you may not access or use the Service. Mollyra AI reserves the right to modify these Terms at any time, and your continued use after modifications constitutes acceptance of the updated terms.

2. Description of Service

Mollyra AI provides a cloud-based artificial intelligence platform that includes:

• Access to large language models and AI APIs
• Image generation capabilities
• Code completion and assistance tools
• Text embeddings and semantic search
• Custom model fine-tuning services
• Developer documentation and SDKs

Mollyra AI may update, modify, or discontinue any feature or component of the Service at any time. We will make reasonable efforts to provide notice of significant changes.

3. Your Account

3.1 Account Registration

You must create an account to access most features of the Service. You agree to provide accurate, current, and complete information during registration and to update your information to keep it accurate.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials, including your API keys. You agree to immediately notify us of any unauthorized use of your account. You are fully responsible for all activities that occur under your account.

3.3 Account Responsibility

You must be at least 18 years old to create an account. You represent that all information you provide is accurate and that you have the right to use any content you submit through the Service.

4. API Usage

4.1 API Access

Subject to these Terms and your subscription plan, Mollyra AI grants you a limited, non-exclusive, non-transferable, revocable right to access and use the API during your subscription period.

4.2 API Keys

Your API key is unique to your account. You may not share, resell, or transfer API keys. You must implement appropriate security measures to protect your API keys from unauthorized access.

4.3 Rate Limits

API usage is subject to rate limits based on your subscription plan. Exceeding rate limits may result in request throttling or temporary suspension of access.

4.4 Usage Limits

API usage is measured by API calls, tokens, or other metrics as determined by your plan. Unused monthly allocations do not roll over unless your plan specifies otherwise.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Generate harmful, hateful, harassing, or violent content
• Create content that facilitates illegal activities
• Impersonate any person or entity
• Distribute malware or malicious code
• Attempt to circumvent rate limits or security measures
• Reverse engineer, decompile, or disassemble the Service
• Use the Service to develop competing products or services
• Resell or sublicense access to the API without authorization
• Use automated systems to access the Service without prior written approval
• Generate content that is defamatory, discriminatory, or sexually explicit without appropriate context
• Override or manipulate safety filtering systems

6. Intellectual Property

6.1 Mollyra AI's Intellectual Property

Mollyra AI retains all rights to the Service, including our technology, APIs, models, documentation, trademarks, and any improvements or modifications. These Terms do not grant you any ownership rights.

6.2 Your Content

You retain all rights to content you provide through the Service ("Your Content"). You grant Mollyra AI a limited license to use Your Content solely to provide and improve the Service.

6.3 Output Content

You retain rights to outputs generated through the Service based on your inputs. However, you are responsible for ensuring your use of outputs complies with these Terms and applicable laws.

6.4 Feedback

If you provide suggestions, ideas, or feedback about the Service, we may use them without obligation to you.

7. Payments

7.1 Fees

Subscription fees are billed in advance according to your selected plan. Usage-based fees are billed in arrears based on measured usage during the billing period.

7.2 Billing

By providing a payment method, you authorize Mollyra AI to charge all fees to that payment method. All fees are non-refundable except as required by law or as specified in our refund policy.

7.3 Overdue Payments

Failure to pay fees may result in suspension of Service access. We may charge interest on overdue amounts at 1.5 percent per month or the maximum rate permitted by law, whichever is lower.

7.4 Price Changes

We may change pricing with 30 days advance notice. Price changes apply to the next billing cycle after the notice period.

8. Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not warrant the accuracy, completeness, or reliability of any outputs generated by the Service.

You acknowledge that AI outputs may contain errors, biases, or inaccuracies. You are responsible for reviewing and validating outputs before using them in production systems.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOLLYRA AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE.

Our total liability for any claims arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

These limitations apply regardless of the form of action, whether in contract, tort, strict liability, or otherwise, and even if we were advised of the possibility of such damages.

10. Indemnification

You agree to indemnify, defend, and hold harmless Mollyra AI and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your Content

11. Termination

11.1 Termination by You

You may cancel your account at any time through your account settings. Termination takes effect at the end of your current billing period.

11.2 Termination by Mollyra AI

We may suspend or terminate your access to the Service at any time for any reason, including:

• Violation of these Terms
• Non-payment of fees
• Requests by law enforcement or regulatory authorities
• Extended periods of inactivity

11.3 Effect of Termination

Upon termination, your right to access the Service ends. We may delete your data and content within 90 days of termination, unless legally required to retain it longer.

12. Changes to Terms

We may update these Terms from time to time. We will provide notice of significant changes by posting the updated terms on our website and updating the "Last updated" date.

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to changes, you must stop using the Service.
